Terms and Conditions for Art Exhibition Entry: Eaglehawk Festivals Inc.

1. Agreement to Terms
   By submitting an entry form or making an entry for the competition, you, the entrant, agree to be bound by these Terms and Conditions. These constitute a legal contract, and non-compliance may result in disqualification from the competition, forfeiture of your entry fee, or legal action. You may also be liable for costs associated with any loss your breach of contract may cause to any party, including Eaglehawk Festivals Inc. if they are sued due to your actions.

2. Understanding and Acceptance
   It is imperative that you read, understand, and accept all terms and conditions before entering the competition. The entry form may reference these terms, directing you to this document for full details. If there are terms you do not understand, seek legal advice. Ensure you are fully aware of your obligations and the implications of participating in the competition, including any potential sacrifices of other opportunities.

3. Copyright and Non-exclusive Licence
   The copyright of submitted works remains with the creator, in accordance with the Copyright Act 1968 (Cth). By entering, you grant Eaglehawk Festivals Inc. a non-exclusive licence to reproduce your work in exhibition materials, promotional content, and on digital platforms. This licence allows us to use your work while not restricting you from granting similar permissions to others.

4. Moral Rights and Use of Your Name
   Entrants retain their moral rights, including the right to attribution and to not have their work derogatorily altered. Be cautious of any terms requiring the waiver of these rights. Eaglehawk Festivals Inc. may use your name, biographical details, and likeness in connection with the competition, but such use will be limited to activities or products related to the competition. Any use of your image or name will respect your reputation and professional standing.

5. Warranties and Indemnities
   By entering, you warrant that your submission is your original work, you have the authority to grant the rights herein, have secured all necessary releases (including location and performer's), and can exploit any underlying rights in the work. You indemnify Eaglehawk Festivals Inc. against losses resulting from breaches of these warranties. Ensure all necessary permissions are documented from the outset.

6. Transportation and Insurance
   Entrants are responsible for the transportation of their artwork to and from the exhibition venue, including all associated costs and insurance during transit. Eaglehawk Festivals Inc. will handle unpacking and repacking of artworks but is not liable for damage or loss during transportation. Artworks will be insured by Eaglehawk Festivals Inc. while on premises for the duration of the exhibition.

7. Liability for Damages
   Eaglehawk Festivals Inc.’s liability for damages related to the exhibition, including but not limited to damage to artworks or personal injury, is capped at $500. Compensation decisions will be at the discretion of the Eaglehawk Festivals Inc. Executive Committee.

8. Rights of Disqualification and Enforcement
   Eaglehawk Festivals Inc. reserves the right to disqualify any participant for breach of these terms, engaging in unlawful conduct, or compromising the integrity of the competition. Legal and equitable remedies to recover damages or other compensation are reserved.

9. Unforeseen Events
   Should external events beyond Eaglehawk Festivals Inc.’s control compromise the exhibition, we reserve the right to modify, suspend, or cancel the event, with the possibility of recommencing under the same terms at a later date.
